Shop4Charity January 2020 Super Calendar Sweepstakes(the “Sweepstakes”) Official Rules (the “Official Rules”)
1. Sponsor and Select Definitions
The “Sponsor” is 10199931 Canada Inc., doing business as Shop4CharityTM. The Sponsor in its sole and absolute discretion may engage various third parties to handle various aspects of the Sweepstakes on its behalf. In these Official Rules, where the context permits or requires, the term “Sponsor” includes those third parties. “Sweepstakes Draw Code” means a unique 10-digit alphanumeric code starting with the letters “SC” that evidences entry into the Sweepstakes and will be used for draw purposes. All times mentioned in these Official Rules are Pacific Time (“PT”) unless otherwise specified. The “Entry Period” begins on July 1, 2019 at 12:00:01 a.m. PT (i.e. midnight) and ends on December 13, 2019 at 11:59:59 p.m. PT.
The Sweepstakes is open only to individuals who are: (a) legal residents of Canada (excluding residents of the Province of Quebec) or the United States (excluding residents of the States of Florida and New York); (b) over the age of majority in his/her province or territory or state of residence and (c) physically located within Canada or the United States at the time of entry and possess a valid draw code. You are NOT eligible to enter the Sweepstakes if, at any time on or after August 1, 2018, you are or were: (a) a director, officer, employee, representative or agent of Sponsor, or any of their respective parents, subsidiaries, or service agencies, any entity engaged in the development, production or distribution/handling of materials for the Sweepstakes, or any other entity engaged in the promotion, advertisement, administration or execution of this Sweepstakes (collectively the “Sweepstakes Entities”); or (b) the member of any immediate families (defined as parents, siblings, children, and spouses, regardless of where they live) or households (whether or not related) of any of the foregoing such persons. The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Sweepstakes. Failure to provide such proof may result in disqualification.
3. How To Enter
No purchase or payment is necessary to enter or win. A purchase will not increase your chances of winning.All no purchase necessary entries must be received by The Sponsor on or before the published Entry Deadline(s).
A. To Enter the Sweepstakes with Purchase: To enter the Sweepstakes with purchase, go online to shop4charity.com, shop4charity.ca, or related and/or affiliated sites, (each and collectively, the “Official Website”) or call 1-855-248-9831, or by mail, submit an order form to Shop4Charity 2020 January Super Calendar Sweepstakes, P.O. Box 10, Brockville, ON, Canada K6V 5T8 and purchase a January 2020 Super Calendar (the “SuperCalendar”). Mail-in orders must be received on or before the applicable Entry Deadline. Purchaser must provide his/her full name, complete address, and telephone number (including area code). Only the purchaser will be considered an entrant. Once you have provided the requisite information and completed the purchase transaction, purchaser will be automatically entered and will receive one (1) unique Sweepstakes Draw Code evidencing such Entry (“Entry” and collectively, the “Entries”) for each Super Calendar (One Entry = One Super Calendar). Super Calendar(s) including the unique Sweepstakes Draw Code(s) evidencing entry into the Sweepstakes will be mailed to the recipients specified in the order within twenty (20) business days from order date. If Super Calendar(s) and/or Sweepstakes Draw Code(s) are not received within twenty-five (25) business days, purchaser should contact the Sponsor to follow up on the order. Note that all communications with Sponsor will be between the entrant and the Sponsor or its agent only. Sponsor is not authorized to contact or to communicate with any third party (including but not limited to relatives of the declared entrant).
B. To Enter the Sweepstakes without Purchase:
To enter the Sweepstakes without purchasing a Super Calendar, send a hand-written Entry by mail to: Shop4Charity 2020 January Super Calendar Sweepstakes, P. O. Box 10, Brockville, ON, Canada K6V 5T8, Attn: 2020 January Super Calendar Sweepstakes Entry. Your Entry request must be legibly hand-printed or written on a blank 8.5” x 11” piece of paper, and must include: (a) an original essay of 200-250 words about how you think charities can best support people in the future (the “Essay”); and (b) your full name, complete mailing address, telephone number (including area code), and a valid email address. Each Essay must be a hand-printed, original composition by the entrant, written specifically for the Sweepstakes and can only be submitted once. You must also include your return address on the exterior of the envelope, which must be legibly hand-printed in ink. Each Entry must be in a separate outer stamped envelope. Entries that are photocopied, hand-stamped, computer-generated, or otherwise mechanically produced or reproduced, without a legible postmark, or that are not printed or written manually in ink, will NOT be honoured and will be deemed void. Upon receipt of a valid Sweepstakes Entry request, you will receive one (1) Entry into the Sweepstakes, and will receive a unique Sweepstakes Draw Code evidencing such Entry for each valid request received. The Sweepstakes Draw Code will be emailed to each entrant within twenty (20) business days from receipt of the valid request. Please check your email and spam filters. If Sweepstakes Draw Code is not received within twenty-five (25) business days please contact the Sponsor. LIMIT: one (1) no-purchase Entry per person per day during the Entry Period. Each Entry request must be in a separate outer stamped envelope, postmarked during the Entry Period, and must be received on or before the applicable Entry Deadline (December 13, 2019).For purposes of ‘Entry without Purchase’ or No Purchase Necessary (NPN), each Entry is considered an ‘Order’.
Each Sweepstakes Draw Code can only be used one (1) time. All Sweepstakes Draw Codes shall be subject to verification and shall be null and void if they are found to not have been obtained or submitted in accordance with these Official Rules. Sponsor is not responsible for late, lost, damaged, mutilated, garbled, undelivered, or postage due Sweepstakes Draw Codes or Entry requests. No mechanical reproductions of Sweepstakes Draw Codes permitted. Use of automated devices is prohibited; automated Entries (including but not limited to Entries submitted using any robot, script, macro or other automated service) are not permitted and may result in disqualification. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and by the decisions of the Sponsor in respect to the Sweepstakes, which decision shall be final and binding with respect to all aspects of the Sweepstakes. In the event of a dispute as to the identity of the person who submitted any Entry, the authorized account holder of the email address submitted at entry will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an access provider, service provider, or other person or organization responsible for assigning email addresses for the account associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
4. Winner Selection
On January 2, 2020 at 9:00 a.m. PT (i.e. 12:00 noon ET) the Sponsor will randomly select one (1) potential winner from among all Entries received during the Entry Period as eligible to win for each of the thirty-one (31) days in the month of January 2020. Draws will be conducted from all eligible entries received by the applicable Entry Deadline. Potential winners must contact the Sponsor by email, phone or mail within 180 days of internet posting. All potential winners must satisfy the prize claim conditions set out below to be eligible to win.
All draws are conducted with a Random Number Generator system (RNG) following an approved procedure; as established by the accounting firm Durand & Associates and under the supervision of internal directors and/or a third party accounting firm.
5. Prize Claim Conditions
Before any potential winner can be declared a winner, he/she must first (i) correctly answer a time-limited mathematical skill-testing question (the “Skill-Testing Question”) without assistance of any kind whether mechanical, electronic or otherwise, and (ii) read, execute and return a declaration of eligibility/release of liability (the “Prize Claim Document”) to the redemption centre (the “Redemption Centre”) by the date indicated on the Prize Claim Document. Potential winners must contact the Sponsor by email, phone or mail within 180 days of internet posting. Once contacted, the Sponsor will administer the required Skill-Testing Question to that individual. Following which, and provided the potential winner correctly answers the Skill-Testing Question, the Sponsor will send that potential winner (via regular mail delivery and/or email to the addresses confirmed by the potential winner) the required Prize Claim Document that the potential winner will be required to complete and return to the Redemption Centre, in a postage-paid envelope which the Redemption Centre will provide to him/her, by email or by fax. The Prize Claim Document will contain, among other things, a declaration of eligibility and compliance with the Official Rules, a liability release and a publicity release and must be actually received (properly completed and signed by the potential winner) by the Redemption Centre on or before the date specified on the Prize Claim Document. When the Redemption Centre receives the completed Prize Claim Document, the Redemption Centre will begin the verification process described in these Official Rules. It is planned that the Redemption Centre will inform the applicable entrant, if he/she is not a verified winner, within approximately twenty (20) business days from the date the completed Prize Claim Document and any other required materials are actually received by the Redemption Centre. If the potential winner is verified as a winner, the Redemption Centre will award the prize which may take 6-10 weeks. Return of any prize or winner notification as undeliverable, failure of selected entrant to respond within 180 days of internet posting, failure to provide proof of eligibility (if requested), Prize Claim Document, or other required documentation by the deadline provided with the documents, failure to complete the Prize Claim Document, failure to correctly answer the Skill-Testing Question, or other non-compliance with these Official Rules may result in disqualification, forfeiture of the prize at the Sponsor’s sole discretion. In the event an entrant is so disqualified, the entrant will have no claim against the Sponsor or any other person respecting the forfeited prize or the Sweepstakes. All information requested by and supplied to the Sponsor for the purpose of the Sweepstakes must be truthful, complete, accurate, and in no way misleading. The Sponsor reserves the right; in its sole discretion to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate, or misleading personal details and/or information, and may require return or repayment of any prize awarded.If an entrant is disqualified or if a potential winner fails to contact the Sponsor within the allotted time, unclaimed prizes are contributed to charity cause partners of equal cash value.
There are thirty-one (31) prizes available to be won, one (1) representing each day of the month of January 2020. The odds of winning depend on the number of eligible entries received during the Entry Period. Five (5) prizes consist of cheques payable to the verified winner totalling $15,000 (fifteen thousand dollars) in 10 monthly instalments. Nine (9) prizes consist cheques payable to the verified winner totalling $10,000 (ten thousand dollars) in 10 monthly instalments. Seventeen (17) prizes consist of cheques payable to the verified winner totalling $5,000 (five thousand dollars) in 10 monthly instalments.US residents are awarded US dollar prizes, Canadian residents are awarded Canadian dollar prizes. Only US and Canadian residents are eligible for the Sweepstakes, some restrictions apply
7. Limitations of Liability
By participating in the Sweepstakes, entrants release and agree to hold the Sweepstakes Entities, and every director, officer, employee, agent, manager and member of any one or more of the Sweepstakes Entities harmless from and against any and all costs, injuries, losses or damages (including without limit direct, indirect, incidental, consequential or punitive damages) of any kind, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or in any activity related to the Sweepstakes, or due in whole or part to the receipt, possession, use or misuse of any prize. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore such exclusions may not apply to you. Without limiting the generality of the foregoing, the Sweepstakes Entities are not responsible for illegible, misdirected, lost, damaged, late, incomplete or stolen Entries, Entry requests, and/or submissions of Prize Claim Document, which may be judged as void; for any damage to an entrant’s computer system or wireless device which is occasioned by accessing the Official Website, by participating in the Sweepstakes, or by redeeming or attempting to redeem a prize; for interrupted, inaccessible, lost, incompatible or unavailable networks, servers, satellites, internet service providers, wireless carriers, websites (including the Official Website), or other connection; for availability or accessibility problems arising in connection with or over the course of the Sweepstakes or any matter related to the Sweepstakes; for miscommunications, scrambled, jumbled, failed, delayed or misdirected computer, telephone or cable transmissions, or hardware or software malfunctions, failures or difficulties; postal delays or other mail disruptions; for any technical malfunctions, failures, or difficulties, printing errors or omissions clerical, typographical or other error(s) or omissions in any materials connected to the Sweepstakes including, without limitation, Sweepstakes Draw Codes, Prize Claim Document, communications whether written or oral, the offering or announcement of any prize or in any prize notification or email or letter; for any errors or omissions or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, or technical in nature; or, for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. In the event of any discrepancy between any printed materials and these Official Rules, the terms of these Official Rules shall govern. The Sweepstakes materials (including Entries) and Prize Claim Documents submitted are the sole property of the Sponsor and will not be returned. Entrants assume all risk of loss, damage, destruction, delay and misdirection of Prize Claim Document and are advised to obtain insurance.
8. General Disclosures
By participating in the Sweepstakes and by submitting a Prize Claim Document, except where legally prohibited, each verified winner hereby agrees and grants the Sponsor the right, but not the obligation, to use his/her name, voice, and likeness, along with his/her address (city/town/village and province/territory) and any statements made by or attributed to such winner in any and all media (including the internet), now known or hereafter devised, in perpetuity and throughout the universe, for advertising and promotional purposes in connection with the Sweepstakes without further notice, review, approval or compensation and releases the Sponsor and all directors, officers, employees, agents, advertising and promotional agencies, representatives, service agencies and independent contractors of the Sponsor from any and all liability with respect thereto.
It is each entrant’s responsibility to ensure that he/she has complied in full with all the conditions and requirements contained in these Official Rules. The Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the process involved in entering the Sweepstakes or with the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
C. Printing and Production Errors or Omissions
The Sponsor has the following rights in respect to termination or modification of the Sweepstakes. Sponsor reserves the right, without prior notice and at any time, to terminate Sweepstakes, in whole or in part, or to modify, suspend or extend the Sweepstakes in any way and for any reason. Without limiting the generality of the foregoing, the Sponsor may terminate the Sweepstakes, in whole or in part, or modify, suspend or extend the Sweepstakes, if it determines, in its sole discretion, that the Sweepstakes is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, glitches, or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity, and/or feasibility of the Sweepstakes. In the event the Sponsor is impeded or prevented from continuing with the Sweepstakes as planned or intended by any event beyond its control, including, but not limited to fire, flood, natural or manmade epidemic or health hazard or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order, or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor’s control, then the Sponsor shall have the right to modify, suspend, extend or terminate the Sweepstakes. Only the number of prizes described in these Official Rules will be awarded in the Sweepstakes. The sole responsibility and liability of any irregular Sweepstakes Draw Code caused by the Sponsor, is replaced with another randomly selected Sweepstakes Draw Code, as solely determined by the Sponsor. Replacement shall be the sole and exclusive remedy under such circumstance. If, due to printing or production errors or omissions or for any other reason whatever, the number of potential prize winners coming forward seeking to claim prizes exceeds the number of prizes as set out in these Official Rules, in the sole discretion of Sponsor, the winner may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).
D. Waiver and Invalidity
Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that a provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference, and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision thereof.
